Can a Customer Cancel Their Purchase?

In Colombia there is a right of withdrawal. This implies that, with some exceptions, for the purchase and sale of goods or services made through a financing system granted by the producer or supplier, time-sharing, or any sale made through the use of a non-traditional or distance method (such as e-commerce), and which by its nature should not be consumed or has not been executed within 5 days, the consumer may terminate the contract, i.e. return things to the initial state and the price paid must be refunded.

Can a Customer Request a Payment Reversal for a Product or Service?

Can a Customer Request a Payment Reversal for a Product or Service?

Yes. If the sale is made by any electronic mechanism, such as the internet or telesales, and an electronic payment instrument (such as a card) has been used, there is an obligation to reverse the payment in the following cases:

  • When the payment was made fraudulently.
  • When the transaction was not requested.
  • When the product purchased is not the one received.
  • When the product is defective.
  • When the product does not match the description.
  • There is a period of 5 days from the time the consumer became aware of any of these circumstances to file a complaint with the supplier and proceed with the refund of the money.

Additional Aspects To Consider?

Additional Aspects To Consider?

Identification Information: If you provide a platform for consumers and sellers to interact, sellers must share identification details that are publicly available so consumers can file complaints or claims.
Product Information:

  • When offering products, you must provide all necessary details (size, measurement, material, nature, uses, properties, quantity, quality, etc.) to help consumers make informed decisions.
  • E-Commerce Details: Clearly state the accepted payment methods, delivery times, and the process for exercising the right of withdrawal.
  • Inform the final price of the product (including taxes, or expenses incurred by the consumer to receive it).
  • Transaction Receipt: After a purchase, send a receipt within one day that includes delivery information, the price, and the payment method.
  • Data Security: Use security measures to protect consumer personal information and transaction details.
  • Facilitate, in the same electronic medium, a mechanism for the consumer to file petitions, complaints or claims.
