The Brazilian Trademark Office has announced important changes to its trademark procedures, effective September 20, 2025. Key updates include adjustments to official fees and the exemption of registration fees for local filings, as well as for second-part fees in international applications designing Brazil in the Madrid Protocol.
New services introduce priority examination for applications filed by low-income individuals and persons with disabilities, along with expedited processing for trademarks with strategic or public policy relevance. A 50% fee reduction will also apply to small businesses, entrepreneurs, public entities, and nonprofit institutions.
Additionally, applicants will be able to claim acquired distinctiveness by demonstrating that a sign has gained recognition through use.
These reforms aim to reduce bureaucracy, cut operational costs, and prevent abandonments due to unpaid fees. This is an opportunity for trademark holders to reassess their strategies in order to take advantage of the new provisions.
