On 9 May, the law regulating the commercialization, consumption, advertising, and use of electronic cigarettes and vape devices was enacted.
As we reported in our OMWD of 15 March 2024, this law extends the restrictions and obligations contemplated in the Anti-tobacco Law aimed at preventing the consumption of these products.
In addition to what was previously reported, this new law includes a sanctioning regime for those producers or marketers who fail to comply with it, as follows:
- Fines between USD 85,055 to USD 102,066 for non-compliance with labeling obligations and warning seals on packaging.
- Fines between USD 680 to USD 1,020 for merchants who fail to comply with advertising prohibitions.
- Fines between USD 85,055 to USD 102,066 for manufacturers and distributors who fail to comply with the advertising prohibitions.
Companies that produce and commercialize these products will have until 9 May 2025 to adopt the necessary measures to comply with the law.
