By means of Resolution No. 364/2024 (August 26th 2024), the National Institute of Industrial Property (INPI) of Argentina created a requirement for pending patent applications claiming priority of a foreign application. Thus, the INPI will now require Applicants to inform whether the claimed priority application has been granted in the country of origin or not, within a term of 60 days. Failing to do so in time will result in abandonment of the pending application.
This requirement will be issued in all pending cases regardless of their current prosecution stage and will be notified to the applicants through a publication in the Patent Notifications Bulletin. With this new measure, the INPI aims to reduce the number of pending cases, since only applicants interested in continuing prosecution are expected to respond to this requirement in a timely manner.
