Recently, the Administrative Court of Cundinamarca issued a key ruling regarding phytotherapeutic products. Citizens filed a Popular Action arguing that these products do not comply with the mandatory chemical analyses required for their sanitary registration, which could pose health risks and affect consumers’ right to information.

The court determined that the lack of regulation for these “natural” medicines exposes consumers to potential risks. Without mandatory chemical analyses, the quality and accuracy of their ingredients cannot be guaranteed. Additionally, the ruling emphasized that people have the right to receive clear and truthful information about the products they consume.

As a result, the court ordered the authority responsible for drug control to require these analyses in the sanitary registration process and instructed the Ministry of Health to update the regulations within six months. Likewise, the court mandated the highest consumer protection authority to strengthen oversight of the advertising of these products to ensure consumer safety and access to reliable information.
