On February 26, 2025, the Constitutional Court, through Ruling T-067, ordered the disclosure of the source code of the application developed during the pandemic (CoronApp), based on the principle of algorithmic transparency. This principle seeks to democratize the internal functioning of automated decision-making systems, ensuring they are understandable to those affected by their operation.

In its decision, the Court determined that disclosing the source code did not compromise information security or the confidentiality of users’ personal data. Furthermore, it concluded that the refusal to provide it constituted a violation of the fundamental right of access to public information.

Consequently, the principle of algorithmic transparency strengthens the right to access public information while emphasizing the importance of personal data protection and citizens’ privacy. As a result, various state entities are urged to establish guidelines on algorithmic transparency and define their obligations in the development of digital tools, ensuring the principle of maximum disclosure.
