Registration of ownership in industrial property Argentina

ownership changes industrial property
Argentina has adopted a new regulation that modifies the way ownership changes and name changes of trademark, patent, utility model, and industrial design owners are recorded before the National Institute of Industrial Property.

The regulation aims to simplify and provide greater clarity to these procedures by expressly setting out the documentation to be submitted and the requirements that must be met by the parties involved. Among the most significant changes, it confirms that documents executed abroad will not require apostille certification or consular legalization to record assignments or name changes before the Argentine authority.

The new regulation also introduces specific rules for certain types of rights transfers, including inheritance proceedings, trusts, asset divisions, and successive chains of assignments. Among other aspects, it clarifies the documentation required to support these transactions, establishes requirements for recording multiple transfers, and defines the circumstances in which an abbreviated chain-of-title procedure may be used to record ownership changes through a single filing.

The measure forms part of the Argentine IP Office’s efforts to modernize and standardize procedures related to the administration of industrial property rights, a development that is particularly relevant for companies managing regional trademark and patent portfolios.
