On March 19, 2026, Cielo Rusinque submitted her resignation from the position of Superintendent of Industry and Commerce after the decision of the Fifth Section of the Council of State became known. The court annulled her appointment after concluding that she did not meet the experience requirements required to hold the position.

However, following the issuance of Decree 0226 of March 5, 2026—which relaxed the requirements for appointment to the position—the Presidency of the Republic once again included Rusinque’s résumé in the public invitation for the nomination of candidates.

Consequently, through Decree 0361 of 2026, she was once again appointed Superintendent of Industry and Commerce, after both Rusinque and President Gustavo Petro publicly rejected the Council of State’s decision that had annulled her initial appointment.

Given that this situation has generated debate among various stakeholders, lawsuits against the new appointment decree have also been announced.
