IA-prepared cassation appeal dismissed by the Court

AI cassation

Colombia’s Supreme Court rejected a cassation appeal in a procedural fraud case after determining that the filing—apparently generated using artificial intelligence—failed to clearly identify the legal error allegedly committed by the appellate court. The Court found that the attorney had merely reproduced generic recommendations generated by AI tools instead of formulating proper legal arguments aligned with the statutory grounds for cassation under Article 181 of Law 906 of 2004. After applying AI-detection tools, the Criminal Chamber concluded there was a high probability the document had been algorithmically generated, reinforcing the finding that the appeal did not meet the minimum procedural requirements established by jurisprudence for cassation filings.
