Administrative tribunal blocks ban on transportation apps

ban blocked on transportation apps

The Administrative Court of Cundinamarca denied the class action lawsuit filed by the Association of Taxi Owners and Drivers against state entities and platforms such as Uber, Didi, and Cabify, which sought to block them for allegedly operating illegally.

The ruling established that class action lawsuits cannot be used to defend trade union interests, and highlighted principles such as technological neutrality, user and consumer rights, and freedom of enterprise. The ruling recognized that these platforms generate benefits to the consumer and recalled that the authorities have already exercised control, citing the sanction imposed by the Superintendency of Transportation on one of them.

Finally, the Court invited the Government to move forward with modern, balanced, and comprehensive regulation for the sector, prioritizing regulation over prohibition.
