The Superintendence of Industry and Commerce (SIC) rejected the request submitted by presidential pre-candidate Sergio Fajardo Valderrama to temporarily block a video published on TikTok, in which, according to him, his image, voice, and name were used without authorization and for possible political purposes. Fajardo argued that the content was part of a sustained disinformation campaign and that it violated his rights and affected his reputation.
After reviewing the request, the SIC concluded that Law 1581 of 2012 on personal data protection does not apply to personal social media accounts, as they are not considered databases regulated by this law. Additionally, it stated that the video may be protected by freedom of speech and information, and that issues related to the truthfulness of the information, reputational impact, or the limits of political discourse must be resolved through the appropriate judicial mechanisms, rather than through administrative procedures for personal data protection.
