Law 2475 of 2025, issued by the Congress of the Republic of Colombia on July 9, 2025, establishes restrictions on the use of medical data related to a history of cancer, particularly in the context of risk assessments linked to the contracting of financial products or services, such as insurance policies.
The regulation expressly prohibits insurers from using a person’s cancer history as a criterion for calculating premiums, establishing exclusions or rejecting coverage.
This provision represents an important advance in the protection of sensitive personal data, in line with the principles enshrined in Law 1581 of 2012. In addition, the law incorporates the concept of the right to be forgotten, preventing a medical condition that has been overcome from being used to the detriment of the holder, thus promoting non-discrimination and equity in access to financial services.
