EU and Brazil: world’s largest secure data-flow area

The European Union (EU) and Brazil have adopted mutual adequacy decisions that allow for the creation of the world’s largest area of free and secure personal data flows, benefiting more than 670 million consumers across both regions. These decisions confirm that the levels of personal data protection in the EU and Brazil are comparable and compatible, facilitating the cross-border exchange of information among companies, public authorities, and researchers.

By recognizing the equivalence of their data protection frameworks, the parties have eliminated the need for additional mechanisms for international data transfers, boosting digital trade, reducing operational costs, and providing legal certainty and stability for European companies operating in Brazil and Brazilian companies present in the European market. This free data flow area also strengthens trade cooperation between the EU and Brazil in the context of the historic Association Agreement and the Interim Trade Agreement with Mercosur.

For Brazilian companies, this also represents a seal of assurance regarding compliance with the data protection standards of that jurisdiction, as it implies recognition from one of the world’s leading regulators in the field of personal data protection, the European Commission.
