INGENIOS Code in Ecuador has entered into force<br \/>\n<\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">On 9 December 2016 &#8211;<span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?sl=es&amp;tl=en&amp;js=y&amp;prev=_t&amp;hl=es-419&amp;ie=UTF-8&amp;u=http%3A%2F%2Fwww.asambleanacional.gob.ec%2Fes%2Fleyes-aprobadas&amp;edit-text=\" target=\"_blank\" rel=\"noopener noreferrer\">through its publication in the Official Registry of the National Assembly<\/a><\/span>&#8211; the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.asambleanacional.gob.ec\/es\/system\/files\/ro-cod-econ-conoc-899-sup-09-12-2016.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Organic Code for the Social Economy, Knowledge, Creativity and Innovation, commonly known as INGENIOS Code<\/a><\/span>, came into force.<\/p>\n<p style=\"text-align: justify;\">Days after, <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.propiedadintelectual.gob.ec\/wp-content\/uploads\/downloads\/2016\/diciembre\/LINEAMIENTOS%20TRANSICI%C3%93N.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">the Ecuadorian Patent Office (IEPI) provided guidance for the transition regime of the new law<\/a><\/span>.\u00a0 It specifically determined that the applications filed before 9 December 2016 will apply the new law for substantive issues, \u00a0while procedural issues will continue to be governed under the old rule. \u00a0Any applications filed after that date will be governed entirely by the INGENIOS Code.<\/p>\n<p style=\"text-align: justify;\">Finally, the IEPI clarifies that the intellectual property rights granted under the previous rule will continue to follow that rule and will conserve their validity.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.olartemoure.com\/en\/om-weekly-digest-05-08-2016\/\" target=\"_blank\" rel=\"noopener noreferrer\">The entry into force of the INGENIOS Code is controversial,<\/a><\/span> as many of its dispositions flagrantly infringe the Andean Law and specifically the Andean IP Code contained in Andean Decision 486.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">a CA.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>LATIN\u00a0AMERICA\u00a0| Judicial Affairs, Prosecution\u00a0| Suspension of deadlines by several Latin American Industrial Property Offices and Courts<br \/>\n<\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.olartemoure.com\/en\/om-weekly-digest-15-12-2016\/\" target=\"_blank\" rel=\"noopener noreferrer\">In addition to the suspension of judicial deadlines in Colombia<\/a><\/span>, other offices that handle IP issues in Latin America have announced their closure during the upcoming holiday season.<\/p>\n<p style=\"text-align: justify;\">In Mexico\u00b4s case, the Mexican IP Office -IMPI in Spanish- informed that <span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?hl=es-419&amp;sl=es&amp;tl=en&amp;u=http%3A%2F%2Fwww.dof.gob.mx%2Fnota_detalle.php%3Fcodigo%3D5463909%26fecha%3D02%2F12%2F2016\" target=\"_blank\" rel=\"noopener noreferrer\">it will suspend activity<\/a><\/span> from 21 December 2016 until 4 January 2017.<\/p>\n<p style=\"text-align: justify;\">As for the Andean Community (which gathers Bolivia, Colombia, Ecuador and Peru), <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.tribunalandino.org.ec\/sitetjca1\/GACE2661.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">the Andean Court of Justice will shut down<\/a><\/span> between 16 December 2016 and 5 January 2017.<\/p>\n<h3 style=\"text-align: center;\"><span style=\"color: #ffffff;\">.\u00a0<\/span><\/h3>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA\u00a0| Regulatory | Colombian Constitutional Court rules on pharmaceuticals pricing procedure<\/strong><\/span><\/h3>\n<p style=\"text-align: justify;\"><span id=\"result_box\" class=\"\" lang=\"en\"><span class=\"\">By means of <span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.googleusercontent.com\/translate_c?depth=1&amp;hl=es&amp;ie=UTF8&amp;prev=_t&amp;rurl=translate.google.com&amp;sl=es&amp;sp=nmt3&amp;tl=en&amp;u=http:\/\/www.corteconstitucional.gov.co\/relatoria\/2016\/C-620-16.htm&amp;usg=ALkJrhjwVeczzZQXMyvlOMwh0AA6g_fBYQ\" target=\"_blank\" rel=\"noopener noreferrer\">Judgment C620 of 2016<\/a><\/span>, the Colombian Constitutional Court ruled regarding the current procedure of pricing of medicines in Colombia and the requirements required for this since the implementation of Law 1753 of 2015 (Evaluation of the Institute of Technological Assessment in Health -IETS in Spanish- and cost-effectiveness analysis, both part of the Marketing Authorization -MA- process).<br \/>\n<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span id=\"result_box\" class=\"\" lang=\"en\"><span class=\"\">The ruling was given because the plaintiff considered that the <span id=\"result_box\" class=\"short_text\" lang=\"en\"><span class=\"alt-edited\">obligatoriness<\/span><\/span> of those requirements &#8220;could affect the availability of pharmaceuticals and entry of new technologies&#8221;, w<span id=\"result_box\" class=\"short_text\" lang=\"en\">hich was estimated as true by the Court.\u00a0 Consequently, the rule remains valid under the understanding that the additional requirements that it includes for the issuance of a MA (necessary to determine the prices of a medicine) <span class=\"alt-edited\">can not injure the elements of availability and accessibility of drugs in the population.<\/span><\/span><br \/>\n<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span lang=\"ES-CO\"><span id=\"result_box\" class=\"\" lang=\"en\"><span class=\"\">Finally, the Court considered that it is valid to revoke an administrative act that grants a MA of its own motion\/<em>ex officio<\/em> and without the prior consent of the holder.<\/span><\/span><\/span><\/p>\n<p><span style=\"color: #ffffff;\">\u00a0<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA, COSTA RICA, LATIN\u00a0AMERICA\u00a0| Patents\u00a0| Costa Rica could enter PROSUR in 2017<br \/>\n<\/strong><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">The Executive Committee of PROSUR was the first to deliver the statement.\u00a0 Additionally, <span style=\"text-decoration: justify;\">The entry of Costa Rica into PROSUR could mean its inclusion in the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.olartemoure.com\/en\/om-weekly-digest-30-09-2016\/\" target=\"_blank\" rel=\"noopener noreferrer\">Patent Prosecution Highway (PPH) suscribed by 8 of its 9 Member Countries<\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\">PROSUR- PROSUL is an agreement which includes 9 South American countries (Argentina, Brasil, Chie, Colombia, Ecuador, Paraguay, Peru, Surinam and Uruguay).\u00a0 Its objective is to promote the cooperation between the Industrial Property Offices of its Member Countries, with the goal of increasing efficiency and quality of the procedure of industrial property applications.<\/p>\n<h3 style=\"text-align:
