Paraguay is now only possible via Internet<\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">Starting 7 November 2016 -and with the issuance of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.dinapi.gov.py\/application\/files\/3214\/7793\/9587\/RESOLUCION_RG-10-16_DISPONE_EL_USO_DEL_FORMULARIO_ELECTRONICO_PARA_RENOVACION_DE_MARCAS.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Regulation N\u00b0 10\/2016<\/a><\/span>, the Paraguayan Trademark Office (DINAPI in Spanish) made a modification to the trademark renewal process, introducing the use of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.dinapi.gov.py\/index.php\/formularios\" target=\"_blank\" rel=\"noopener noreferrer\">electronic forms<\/a><\/span> as the only mechanism to make\u00a0such requests.<\/p>\n<p style=\"text-align: justify;\">DINAPI&#8217;s goal is that all intellectual property\u00a0process can be done using electronic forms.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">s .<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>ANDEAN COMMUNITY (BOLIVIA, COLOMBIA, ECUADOR and PERU)\u00a0| Industrial Designs, Industrial Property | Andean Community: the novelty and distinctiveness of an industrial design may be affected by a figurative trademark<\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">By means of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/intranet.comunidadandina.org\/Documentos\/Procesos\/477IP2015.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Prejudicial Interpretation 477-IP-2015<\/a><\/span>, the Andean Court of Justice (ACJ) provided its binding legal opinion in a\u00a0invalidity action filed by Pfizer before the Council of State of Colombia against the granting of an industrial design of a pharmaceutical tablet (very similar to the pill design used by Pfizer in VIAGRA, registered as a figurative trademark in Colombia) in favor of Lafrancol, considering that the industrial designs lacks novelty and distinctiveness.<\/p>\n<p style=\"text-align: justify;\"><strong>The ACJ defined the guidelines that -mandatorily- the Council of State has to consider when comparing the industrial design with the figurative trademark<\/strong>, indicating that has to evaluate &#8220;<em>if the granted design is confusing or not with the figurative trademark previously registered<\/em>&#8220;, as <strong>an industrial design needs to comply with novelty and distinctiveness requirements<\/strong>.\u00a0\u00a0A graphical comparison -focused in an overall analysis between the design and the trademark, concerning the traces, lines, features and other external characteristics of both-\u00a0must be done to determine if there are similarities in the industrial design as regards to the figurative trademark, allowing to conclude the lack or fulfillment of novelty requirement if\u00a0there is a trademark with the same external shape in the market.<\/p>\n<p style=\"text-align: justify;\">In the binding legal opinion was reiterated that an industrial design (i) cannot\u00a0be know in any way at a global level prior to filing date or when priority is claimed -in order to not affect its novelty-, as well as\u00a0(ii) it\u00a0cannot entail the usual shape of products, as neither can be confusing with other distinctive signs previously registered -like figurative trademarks- <strong>in order to not affect its <span style=\"text-decoration: underline;\">distinctiveness<\/span>, which is mandatory\u00a0even if this is not explicitly mentioned as a requirement in the\u00a0Andean applicable law<\/strong>.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">y\u00a0<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>WORLD\u00a0| Patents\u00a0| WIPO launches patent search service using chemical\u00a0structures<\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">Since October 2016, WIPO&#8217;s <span style=\"text-decoration: underline;\"><a href=\"https:\/\/patentscope.wipo.int\/search\/en\/reg\/login.jsf;jsessionid=8A1864FBF20F4931B3DA513296661A18.wapp2nB\" target=\"_blank\" rel=\"noopener noreferrer\">PATENTSCOPE<\/a><\/span> platform allows the search of patents using chemical structures. \u00a0The tool recognizes the name of the chemical components used in patent texts (in title,\u00a0abstract, claims and description fields), as well as identifies the chemical structures based on the drawings incorporated in the patents.<\/p>\n<p style=\"text-align: justify;\">For now, the chemical structure search is only available for applications published in english and german (in the future it will be enabled in other languages), as well as for patents filed in USA since 1979.<\/p>\n<p style=\"text-align: justify;\"><span
