target=\"_blank\" rel=\"noopener noreferrer\">the Plenary of the Ecuadorian Congress approved in second debate<\/a><\/span> the bill containing a new Intellectual Property Law -better known as <span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?hl=es-419&amp;sl=es&amp;tl=en&amp;u=http%3A%2F%2Fcoesc.educacionsuperior.gob.ec%2Findex.php%2FC%25C3%25B3digo_Org%25C3%25A1nico_de_Econom%25C3%25ADa_Social_del_Conocimiento_e_Innovaci%25C3%25B3n\" target=\"_blank\" rel=\"noopener noreferrer\"><em>C\u00f3digo INGENIOS<\/em><\/a><\/span>-.<\/p>\n<p style=\"text-align: justify;\">The final text of <em>C\u00f3digo INGENIOS<\/em> is now awaiting presidential approval for its entry into force.<\/p>\n<p style=\"text-align: justify;\">As we indicated in an earlier version of OM Weekly Digest,\u00a0<span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.olartemoure.com\/en\/om-weekly-digest-05-08-2016\/\" target=\"_blank\" rel=\"noopener noreferrer\">Ecuador would violate Andean Law \u00a0(like Decision 486\/2000) and TRIPS agreement with <em>C\u00f3digo INGENIOS<\/em><\/a><\/span>, since\u00a0it contains provisions on\u00a0intellectual property and patents contrary to these laws and treaties.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>BRAZIL\u00a0| Patents\u00a0| Brazil and Japan signed an agreement to implement a Patent Prosecution Highway (PPH)<\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">On 6 October 2016, Representatives of the Governments of Brazil and Japan signed an agreement which established a working group in order to\u00a0implement a Patent Prosecution Highway (PPH) between the Patent target=\"_blank\" rel=\"noopener noreferrer\">please see the following link<\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">\u00a0<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA\u00a0| Trademarks\u00a0| Colombian Trademark Office moves away from judicial precedent and considers that trademarks registered in France does not have automatic protection<\/strong><\/span><\/h3>\n<p style=\"text-align: justify;\">By means of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/10\/160624-Res-41632-Convencion-Colombo-Francesa-sobre-PI.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Resolution 41632 of 24 June 2016<\/a><\/span>, the Superintendence of Industry and Commerce provides that trademarks registered in France will not have an automatic protection in Colombia.<\/p>\n<p style=\"text-align: justify;\">This is due to the interpretation given by the SIC to the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.wipo.int\/edocs\/trtdocs\/es\/co-fr\/trt_co_fr.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Colombian-French Convention on Intellectual Property of 1901<\/a><\/span> (incorporated into Colombian legislation by means of Decree 597 of 1901) arguing\u00a0that there is no automatic registration of a trademark in Colombia based on a French trademark. \u00a0The above, because formal requirements imposed by Colombian Law\u00a0are mandatory, according to the principle of territoriality.<\/p>\n<p style=\"text-align: justify;\">Thereby, the SIC moves away from the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/10\/020208-Sentencia-08-02-2002-Exp-5950-Caso-Louis-Vuitton.doc\" target=\"_blank\" rel=\"noopener noreferrer\">interpretation given by the Colombian Supreme Court of Justice in Louis Vuitton case<\/a><\/span>, which argues that for the simple fact of acquiring legitimately a trademark in France, derivative rights product of that registration will be protected in Colombia without a domestic trademark application.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA\u00a0| Regulatory\u00a0| Applications for import authorization\u00a0in <em>Plan Vallejo<\/em> mode for products monitored by the Colombian Regulatory Authority now will be filed\u00a0digitally<\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">Starting 9 October 2016, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?hl=es-419&amp;sl=es&amp;tl=en&amp;u=https%3A%2F%2Fwww.invima.gov.co%2Fatenci%25C3%25B3n-importador-plan-vallejo\" target=\"_blank\" rel=\"noopener noreferrer\">the Colombian Regulatory Authority (INVIMA in Spanish) will not require<\/a><\/span> to file in physic the application for import authorization in <em>Plan Vallejo<\/em> mode for commodities of products monitored by it. \u00a0Since that date, application for authorization in\u00a0<em>Plan Vallejo<\/em> mode must be filed before\u00a0<span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?hl=es-419&amp;sl=es&amp;tl=en&amp;u=http%3A%2F%2Fwww.vuce.gov.co%2F\" target=\"_blank\" rel=\"noopener noreferrer\">VUCE Platform<\/a><\/span> (Single Window for Foreign Trade system) using an Import Registration.<\/p>\n<p style=\"text-align: justify;\">The above,\u00a0according to the provisions of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.vuce.gov.co\/fileman\/files\/vallejo\/resoluci%C3%B3n_1649.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Resolution 1649 (31\/08\/2016)<\/a><\/span> -which develops requirements for systems of import and export- and <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.mincit.gov.co\/loader.php?lServicio=Documentos&amp;lFuncion=verPdf&amp;id=4923\" target=\"_blank\" rel=\"noopener noreferrer\">Circular 022 of 16 September 2016<\/a><\/span>, both issued by the Ministry of Commerce, Industry and Tourism.<\/p>\n<p style=\"text-align: justify;\">The<em> Plan Vallejo<\/em>\u00a0operates since 1967, and allows importation of raw materials without rel=\"noopener noreferrer\">Resolution 798-2016<\/a><\/span> from the Peruvian Ministry of Health, the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.digemid.minsa.gob.pe\/UpLoad\/UpLoaded\/PDF\/DIRECTIVABPM.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Administrative Directive 165-MINSA\/DIGEMID V.01<\/a><\/span> of 2010 for Certification of Good Manufacturing Practices (GMP) in national and foreign laboratories\u00a0was modified.<\/p>\n<p style=\"text-align: justify;\">The modification was made in order to update the Administrative Directive to new sanitary laws and provide precision in certain aspects, especially regarding the time to perform certification procedure (90 working days) and as to the validity of GMP
