&#8220;Internal Patent Prosecution Highway&#8221; (IPPH)<\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">Starting 15 October 2016 \u2013and by means of <span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?sl=es&amp;tl=en&amp;js=y&amp;prev=_t&amp;hl=es-419&amp;ie=UTF-8&amp;u=http%3A%2F%2Fservicios.infoleg.gob.ar%2FinfolegInternet%2Fanexos%2F265000-269999%2F265573%2Fnorma.htm&amp;edit-text=\" target=\"_blank\" rel=\"noopener noreferrer\">Resolution 56 (12 September 2016)<\/a><\/span>-, the Argentine Patent Office (INPI in Spanish) will allow the utilization of an \u201cInternal Patent Prosecution Highway\u201d.<\/p>\n<p style=\"text-align: justify;\">According to the Resolution, the INPI will apply an accelerated patent procedure that may go far beyond the traditional PPH, since it potentially will consider the international search and patentability requirements fulfilled by allowing homologation of patentability results obtained in a third country and automatically transfer them to Argentina. \u00a0To do so, the applicant must show\u00a0that the foreign Patent Office which granted the patent (i) conducted substantive examination and (ii) applied the same INPI requirements for patentability. \u00a0Given the questionable Argentine Patentability Guidelines in force, this\u00a0begs the question, who has the same INPI requirements?<\/p>\n<p style=\"text-align: justify;\">Additionally, the INPI (iii) will evaluate observations submitted by third parties,and will review if (iv) the claim scope is less than or equal to the one from the foreign granted patent, and (v) if the claimed subject matter is patentable in Argentina.<\/p>\n<p style=\"text-align: justify;\">The \u201cIPPH\u201d will apply only to patent applications that meet the above requirements and which have not yet undergone substantive examination in Argentina.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>SOUTH AMERICA (ARGENTINA, BRAZIL, CHILE, COLOMBIA, ECUADOR, PARAGUAY, PERU and URUGUAY)\u00a0| Patents\u00a0|\u00a0<u>8 South-American countries will implement a Patent Prosecution Highway (PPH) together<\/u><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">On 16 September 2016 (and under the PROSUR Cooperation Agreement), representatives from\u00a0Argentina, Brazil, Chile, Colombia, Ecuador, Paraguay, Peru and Uruguay Patent Offices publicized\u00a0the entry into force of a Patent Prosecution Highway between their countries. \u00a0Thereby, they give effect to the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.dinapi.gov.py\/application\/files\/2114\/6402\/2996\/MEMORANDUM_DE_ENTENDIMIENTO_PROGRAMA_PILOTO_PATENTES_SIST._COOP._PROP._INDUS._PROSUR_-_PROSUL.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Memorandum of Understanding<\/a><\/span> signed in May 2016.<\/p>\n<p style=\"text-align: justify;\">The procedure \u2013which will be available in Mottainai and PCT versions- will accelerate Office Actions among participating Offices and will be tested for a period of three years (renewable for an additional year). \u00a0After that period, its final adoption will be decided. \u00a0The publication of PROSUR PPH Guidelines should occur in the next days.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">\u00a0<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>ARGENTINA\u00a0| Regulatory\u00a0|\u00a0New rules on access to pharmaceuticals not distributed in Argentina<\/strong><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">On 22 September 2016 \u2013and by means of <span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?hl=es-419&amp;sl=es&amp;tl=en&amp;u=http%3A%2F%2Fservicios.infoleg.gob.ar%2FinfolegInternet%2Fanexos%2F265000-269999%2F265684%2Fnorma.htm&amp;sandbox=1\" target=\"_blank\" rel=\"noopener noreferrer\">Regulation 10401\/2016<\/a><\/span>-, the Argentine Regulatory Authority (ANMAT in Spanish) implemented an Access Exception Regime to Pharmaceuticals (RAEM in Spanish).<\/p>\n<p style=\"text-align: justify;\">RAEM will allow the import of medicines not available in Argentina for patients in exceptional situations, in which (i) the needed pharmaceutical is not available in the country, and (ii) clinical conditions do not allow the use of internally available medications. \u00a0The importation of experimental pharmaceuticals will also be allowed, if the risk-benefit balance is acceptable to the patient and his life is at serious risk.<\/p>\n<p style=\"text-align: justify;\">The following documents are required to access RAEM: prescription, clinic history, informed consent and proof of the distribution in a third country. \u00a0An authorization will be given within 60 days.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>BRAZIL\u00a0| Patents\u00a0|\u00a0Brazil issues new guidelines for examination of patent applications<\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">On 15 July 2016 \u2013and by means of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.inpi.gov.br\/menu-servicos\/arquivos-dirpa\/modulo2.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Resolution 169\/2016<\/a><\/span>\u00a0(<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/09\/160929-Guia-examen-solicitudes-de-patente-Brasil-Bloque-II-Comprimida.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">low-res PDF<\/a><\/span>)- the Brazilian Patent Office (INPI in Portuguese) issued a new guide for examination of patent applications (known as <em>Examination of Patent Applications Guideline \u2013 Block II \u2013 Patentability<\/em>).<\/p>\n<p style=\"text-align: justify;\">The new guide clarifies and defines some aspects regarding patentability requirements (novelty and inventive step analysis). It also provides guidance\u00a0on second use inventions, Markush-style claims and selection patents.<\/p>\n<p style=\"text-align: justify;\">Significant changes\u00a0includes: (i) the express acceptance of\u00a0second use claims drafted in Swiss-type format, (ii) recognition of specific criteria for the patenting of selection patents, and (iii) guidance for claim drafting.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">\u00a0<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>ARGENTINA\u00a0| Regulatory\u00a0| Argentina updates list of active ingredients that determine which pharmaceuticals are traceable<\/strong><\/span><\/h3>\n<p style=\"text-align: justify;\">On 22 September 2016 and by means of <span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?sl=es&amp;tl=en&amp;js=y&amp;prev=_t&amp;hl=es-419&amp;ie=UTF-8&amp;u=http%3A%2F%2Fservicios.infoleg.gob.ar%2FinfolegInternet%2Fanexos%2F265000-269999%2F265786%2Fnorma.htm&amp;edit-text=\" target=\"_blank\" rel=\"noopener noreferrer\">Regulation 10564\/2016<\/a><\/span>, the Argentine Regulatory Authority (ANMAT in Spanish) updated the list of active ingredients in pharmaceuticals that should be tracked in the Medicine Traceability System.<\/p>\n<p style=\"text-align: justify;\">All medications containing one or more of the 298 active ingredients listed in the Regulation must\u00a0be tracked during its supply chain.<\/p>\n<p style=\"text-align: justify;\">The Medicine Traceability System seeks to identify pharmaceuticals marketed in Argentina in order to understand the\u00a0logistics linked to them (among others).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>.
