if it passes domestic Intellectual Property bill<\/strong><\/u><\/strong><\/h3>\n<p><span style=\"color: #ffffff;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">There is a <span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?sl=es&amp;tl=en&amp;js=y&amp;prev=_t&amp;hl=es&amp;ie=UTF-8&amp;u=http%3A%2F%2Fcoesc.educacionsuperior.gob.ec%2Findex.php%2FC%25C3%25B3digo_Org%25C3%25A1nico_de_Econom%25C3%25ADa_Social_del_Conocimiento_e_Innovaci%25C3%25B3n%23Informe_del_C.C3.B3digo_Ingenios_para_primer_debate_en_Pleno_de_la_Asamblea_Nacional&amp;edit-text=\" target=\"_blank\" rel=\"noopener noreferrer\">pending bill<\/a><\/span> before the Ecuadorian Congress covering a new intellectual property law known as <em>C\u00f3digo INGENIOS<\/em>, which contains some provisions that not only violate the TRIPS Agreement, but also directly contravenes Andean Community Law by ignoring the existence of the Andean Common Industrial Property Regime (Decision 486 of 2000).<\/p>\n<p style=\"text-align: justify;\">The <em>C\u00f3digo INGENIOS<\/em> bill proposes that intellectual property rights will be conditioned to the role and social responsibility of the Ecuadorian State (<span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?hl=es&amp;sl=es&amp;tl=en&amp;u=http%3A%2F%2Fcoesc.educacionsuperior.gob.ec%2Findex.php%2FLIBRO_III_De_la_Gesti%25C3%25B3n_de_los_Conocimientos&amp;sandbox=1\" target=\"_blank\" rel=\"noopener noreferrer\">Art. 82<\/a><\/span>), aspect that has generated a heated debate in the Andean country because IP rights nationalization could be possible if the government so decides.<\/p>\n<p style=\"text-align: justify;\">The bill\u2019s text is also controversial in patent matters (<span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?hl=es&amp;sl=es&amp;tl=en&amp;u=http%3A%2F%2Fcoesc.educacionsuperior.gob.ec%2Findex.php%2FLIBRO_III_De_la_Gesti%25C3%25B3n_de_los_Conocimientos\" target=\"_blank\" rel=\"noopener noreferrer\">Art. 254 and others<\/a><\/span>) ; it excludes from patentable subject matter (i) new forms of a substance, for example, in salts, ethers and combinations (among others) and (ii) polymorphs and isomers (and others).<\/p>\n<p style=\"text-align: justify;\"><em>C\u00f3digo INGENIOS<\/em> approval may also constitute a setback to foreign investment and trade by creating an obstacle to the accession of Ecuador to the Free Trade Agreement currently in negotiations with the European Union (in force in Colombia and Peru). \u00a0The bill provisions overly infringe the Intellectual Property Chapter of the mentioned FTA.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA, MEXICO | Regulatory | <strong>Mexican and Colombian Regulatory Authorities issued guidelines regarding Good Manufacturing Practices (GMPs) for pharmaceuticals<\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">The Colombian and Mexican Regulatory Authorities (INVIMA and COFEPRIS respectively) <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.invima.gov.co\/images\/pdf\/informate\/Comunicado_conjunto_INVIMA_COFEPRIS_25072016.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">issued a shared process<\/a><\/span> for the recognition of inspection acts related to GMPs for laboratories located in Mexico and\/or Colombia.<\/p>\n<p style=\"text-align: justify;\">The agreement is within the framework of the Pacific Alliance \u2013which includes Chile and Peru- and will reduce the time needed to obtain a health registration for chemically synthesized pharmaceuticals.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>SPAIN\u00a0| Patents\u00a0| <strong>Spain updates guidelines for examinations in patent applications<\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">The <span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?hl=es&amp;sl=es&amp;tl=en&amp;u=http%3A%2F%2Fwww.oepm.es%2Fes%2Fsobre_oepm%2Fnoticias%2F2016%2F2016_07_28_ActualizacionDirectricesExamenSolicitudesPatentes.html\" target=\"_blank\" rel=\"noopener noreferrer\">update<\/a><\/span> specifically reformed the search guidelines and the prior art report, dividing it into two separate documents: (i) <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.oepm.es\/comun\/documentos_relacionados\/Invenciones\/DirExPat_DIRECTRICES_Version_2_0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">guidelines for patent examination<\/a><\/span>, and (ii) <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.oepm.es\/comun\/documentos_relacionados\/Invenciones\/DirExPat_Parte_B_Version_Parcial_2_3.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">guidelines for the preparation of Written Opinions<\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\">The renovation of the guidelines took place on July 28, 2016, and the main purpose was to provide more transparency for the methods used when conducting searches and reports.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">\u00a0<\/span><\/p>\n<h3 style=\"text-align: center;\"><strong><u>URUGUAY | Patents | <strong>Uruguay will allow digital presentation of patents and trademarks<\/strong><\/u><\/strong><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">The <span style=\"text-decoration: underline;\"><a href=\"https:\/\/translate.google.com\/translate?hl=es&amp;sl=es&amp;tl=en&amp;u=http%3A%2F%2Fwww.dnpi.gub.uy%2Fweb%2Fmarcas-y-patentes%2Fnoticias\" target=\"_blank\" rel=\"noopener noreferrer\">Uruguayan National Directorate of Intellectual Property<\/a><\/span> will allow the digital presentation of patents and trademarks, with the objective of creating a completely digital system.<\/p>\n<p style=\"text-align: justify;\">The system is currently at an early stage, and will begin to formalize digital submissions of intellectual property, by assigning a serial number.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA | Patents\u00a0| <strong>Budapest Treaty is now in force for Colombia<\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">On \u00a026 July 2016, Colombia\u2019s adhesion to the <em>Budapest Treaty on the International Recognition of the Deposit of Microorganism for the Purposes of Patent Procedure <\/em>\u2013adopted in 1977- became final.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.wipo.int\/treaties\/en\/notifications\/budapest\/treaty_budapest_313.html\" target=\"_blank\" rel=\"noopener noreferrer\">Colombia\u2019s adhesion<\/a><\/span> to the treaty reaffirms Andean Law provisions (established in Decision 486) for the deposit of biological material \u2013and specifically for microorganisms- in patent applications if necessary.<\/p>\n<p style=\"text-align: justify;\">The <a href=\"http:\/\/www.wipo.int\/wipolex\/en\/treaties\/text.jsp?file_id=283784\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"text-decoration: underline;\">Budapest Treaty<\/span><\/a> simplifies the requirements for biological material deposit before States party national authorities in which patent protections is desired, allowing microorganism deposit before an authorized
