The decision was based on the World Health Organization (WHO) <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.who.int\/fctc\/text_download\/en\/\" target=\"_blank\" rel=\"noopener noreferrer\">Framework Convention on Tobacco Control<\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\">\u00a0The final decision established that the investment of Philip Morris was not affected since: (i) there cannot exist an investment expropriation where there is sufficient business value; and (ii) the measures taken by the Uruguayan Government were not arbitrary, since they were implemented as legitimate public health measures designed to protect population and it constitutes a valid exercise of a Sovereign State regulatory powers.<\/p>\n<p style=\"text-align: justify;\">We recommend reading the award (<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/07\/160714-Award-Philip-Morris-vs-Uruguay-ICSID.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">available here<\/a><\/span>) as it establishes criteria evaluating the scope of public health measures, among others.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA | Trademarks\u00a0| <strong>\u201cCountry Hill\u201d trademark for orange and fruit drinks obtained Well-Know Trademark status <\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">The Colombian Trademark Office (CTO) issued <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/07\/160714-SIC-R.-40124-Country-Hill.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Resolution 40124 of 2016<\/a><\/span>, recognizing the notoriety of \u201cCountry Hill\u201d trademark, registered in Class 32 of Nice Classification. The decision was taken based on the \u00a0opposition filed by \u00a0Meals de Colombia S.A.S, -a company from the Nutresa business group- against the registration of \u201cTURKEY HILL\u201d trademark (requested by Turkey Hill L.P. to distinguish \u201cice cream, yogurt, diet ice cream\u201d products in Class 30 and \u201clemonades and fruit drinks\u201d in Nice 32 Class). The opposition was based on the high risk of unfair exploitation of \u201cCOUNTRY HILL\u201d trademark.<\/p>\n<p style=\"text-align: justify;\">The effects \u00a0of the declaration of notoriety of a trademark, are as follows: \u00a0(i) breaking the principle of specification (which implies analysis of trademark confusion, distinctiveness \u00a0and dilution risk, \u00a0regardless of Nice Class); (ii) breaking the principle of territoriality among Paris Convention members countries and; \u00a0(iii) trademark protection even if it has not been registered.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA\u00a0| Regulatory\u00a0| <strong>In force Law allowing Cannabis and derivate products for medical and scientific use<\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">Despite the existence of Decrees (<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/06\/160603-Decreto-2467-2015.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">2467 of 2015<\/a><\/span> \u2013included in the new Health Regulation Decree -780\/2016- ) and Regulations (<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/06\/160603-Resolucion-1816-2016.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">1816\/2016<\/a><\/span>) enabling the granting of crop and manufacturing licenses of cannabis for medical and scientific purposes -and even the granting of licenses for the manufacturing of Cannabis derivatives-, only until 6 July 2016 was issued the Law legalizing Cannabis use in Colombia for medical and scientific purposes (<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/07\/160714-L.-1787-2016-Cannabis.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">1787 of 2016<\/a><\/span>).<\/p>\n<p style=\"text-align: justify;\">The new law creates a regulatory framework allowing safe and informed Cannabis and derivate products access for medical and scientific purposes.\u00a0 Among its principal aspects, it indicates that the State takes control and regulation of crop, production, manufacturing, acquisition (and inter alia) activities related to Cannabis and its derivatives.<\/p>\n<p>It is important to mention that the Colombian Government \u2013via Ministry of Health and Social Protection, among others-, will charge license applicants and owners for evaluation and monitoring services.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">\u00a0<\/span><\/p>\n<h3 style=\"text-align: center;\"><strong><u>CANADA, ECUADOR, GUATEMALA, WORLD\u00a0| Copyright Law\u00a0| <strong>Marrakesh Treaty will enter in force<\/strong><\/u><\/strong><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">As from 30 September 2016, the Marrakesh Treaty \u201c<em>to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired or Otherwise Print Disabled<\/em>\u201d will come in force, due to accessions effected by Ecuador, Guatemala and Canada during the last week of June 2016.<\/p>\n<p style=\"text-align: justify;\">In Latin America, the Treaty has been <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.wipo.int\/treaties\/en\/ShowResults.jsp?lang=en&amp;search_what=N&amp;treaty_id=843\" target=\"_blank\" rel=\"noopener noreferrer\">ratified and\/or accessed<\/a><\/span> (in chronological order) by El Salvador, Uruguay, Paraguay. Argentine, Mexico, Brazil, Peru, Chile, Ecuador and Guatemala, being pending the accession and\/or ratification of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.wipo.int\/treaties\/en\/ShowResults.jsp?lang=en&amp;treaty_id=843\" target=\"_blank\" rel=\"noopener noreferrer\">contracting parties<\/a><\/span> like Colombia, Costa Rica, Dominican Republic and Panama.<\/p>\n<p style=\"text-align: justify;\">The treaty may be consulted <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.wipo.int\/wipolex\/en\/treaties\/text.jsp?file_id=301019\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a><\/span>.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>.
