force<\/strong><\/u><\/strong><\/h3>\n<p><span style=\"color: #ffffff;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">As from 1 July 2016 came into force some agreements regarding\u00a0Patent Prosecution Highway (PPH) in different Latin American countries.<\/p>\n<p>The Patent Prosecution Highway pilot program between the Pacific Alliance countries Patent Offices (Chile \u2013INAPI-, Colombia \u2013SIC-, M\u00e9xico \u2013IMPI- and Peru \u2013INDECOPI-) entered into force for a period of 3 years. \u00a0After that, the full execution and implementation of the program will be analyzed. \u00a0The participating Offices provided the following guidelines:<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.inapi.cl\/portal\/publicaciones\/608\/w3-propertyvalue-911.html\" target=\"_blank\" rel=\"noopener noreferrer\">Guidelines from INAPI to\u00a0SIC, IMPI and INDECOPI<\/a><\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/07\/160707-PPH-SIC-INAPI-IMPI-INDECOPI.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Guidelines from SIC to INAPI, IMPI and INDECOPI<\/a><\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><a INDECOPI<\/a><\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.indecopi.gob.pe\/web\/invenciones-y-nuevas-tecnologias\/pph\" target=\"_blank\" rel=\"noopener noreferrer\">Guidelines from INDECOPI to INAPI, SIC and IMPI<\/a><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Additionally, in Colombia also came into force the\u00a0<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/07\/160707-PPH-SIC-EPO.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">PPH agreement<\/a><\/span> subscribed between the Colombian Patent Office (CPO)\u00a0and the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.epo.org\/law-practice\/legal-texts\/html\/guidelinespct\/e\/e_ii_1.htm\" target=\"_blank\" rel=\"noopener noreferrer\">EPO<\/a><\/span>. \u00a0The CPO has already signed agreements with the\u00a0<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.kipo.go.kr\/kpo\/user.tdf?a=user.english.html.HtmlApp&amp;c=100016&amp;catmenu=ek02_02_03#a20\" target=\"_blank\" rel=\"noopener noreferrer\">KIPO<\/a><\/span>, <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.jpo.go.jp\/torikumi_e\/t_torikumi_e\/japan_colombia_highway_e.htm\" target=\"_blank\" rel=\"noopener noreferrer\">JPO<\/a><\/span>, <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.oepm.es\/cs\/OEPMSite\/contenidos\/PPH\/PPH.htm\" target=\"_blank\" rel=\"noopener noreferrer\">OEPM<\/a><\/span> and <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.uspto.gov\/patents-getting-started\/international-protection\/patent-prosecution-highway\/patent-prosecution-6\" target=\"_blank\" rel=\"noopener noreferrer\">USPTO<\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\">The PPH aims to accelerate the examination process for corresponding applications filed in participating intellectual property Offices, allowing applicants to\u00a0favorable decisions of other participant Offices.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA | Trademarks\u00a0| Due to<strong>\u00a0high degree of distinctiveness, \u201cDoria\u201d obtained Well-Know Trademark status<\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/06\/DORIA.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">The Colombian Trademark Office issued the decision related to the trademark \u201cDORIA\u201d<\/a><\/span> \u2013for \u201cpastas\u201d- (belonging to Class 30 of Nice International Classification), since \u201cDoria\u201d \u2013belonging to one of Grupo Nutresa companies- faced a\u00a0risk of dilution if \u201cVILLADORIA\u201d trademark was\u00a0registered under Class 33 of Nice Classification (alcoholic beverages \u2013except beers-).<\/p>\n<p style=\"text-align: justify;\">The rejection of the\u00a0\u201cVILLADORIA\u201d trademark was mainly\u00a0motivated by the likelihood of confusion and distinctiveness dilution that could be presented with \u201cDORIA\u201d well-known trademark, as there is a large number of consumers in common for both products. \u00a0The CTO considered\u00a0there is a Nice Class relation between products such as wine and pasta.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA\u00a0| Intellectual Property\u00a0| <strong>Colombia is close to having law for the promotion and protection of Creative Economy<\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">On 16 June 2016, Colombian Congress <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.imprenta.gov.co\/gacetap\/gaceta.mostrar_documento?p_tipo=1698&amp;p_numero=104&amp;p_consec=44999\" target=\"_blank\" rel=\"noopener noreferrer\">approved the final text of Bill No. 104 of 2016,<\/a><\/span> which aims to develop, promote, encourage and protect creative industries, understood as those that \u2013based in intellectual property- generate value in virtue of their goods and services (industries like publishing, tourism, audiovisual, cultural creativity or l+D+I, fashion, among others) and currently representing 3.5% of Colombian Gross Domestic Product.<\/p>\n<p style=\"text-align: justify;\">Once in force, the law will promote the Integral Creative Economy Policy (also named <em>Orange Economy<\/em>) which seeks the development of creative industries through a public policy based on 7 action fields: (i) information, (ii) institutions, (iii) industry, (iv) infrastructure, (v) integration, (vi) inclusion and (vii) inspiration.<\/p>\n<p style=\"text-align: justify;\">In addition, the Colombian Government will offer tax incentives for those who exercise patronage, sponsorship and auspice of creative industries, and also will facilitate access to finance programs in the industry.<\/p>\n<p style=\"text-align: justify;\">The next links (<span style=\"text-decoration: underline;\"><a copyright.<\/li>\n<li>Pacts and agreements between collective management societies, copyright and related rights societies (national and foreign).<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: a fact<\/strong><\/u><\/strong><\/h3>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">During the last week of June and the first of July 2016, <span style=\"text-decoration: underline;\"><a href=\"https:\/\/www.minsalud.gov.co\/Paginas\/Colombia-otorga-primera-licencia-para-fabricar-derivados-de-cannabis.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">the Colombian Government<\/a><\/span> (through the Ministry of Health\u00a0\u2013which study the granting of crop and manufacturing licenses of cannabis for medical and the Ministry of Health there are other four companies in line to obtain the manufacturing license.<\/p>\n<p style=\"text-align: justify;\">Until now, the granted licenses only allow the manufacture of Cannabis derivative products. \u00a0It is pending the granting of the first Cannabis crop license in Colombia \u2013both licenses for medical and scientific
