ANDEAN COMMUNITY\u00a0| Patents\u00a0| <strong>Andean Community Secretariat: High fees in Ecuador patent prosecution does not infringe Andean regulations (for now)<\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">By means of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/05\/Dictamen-002-16.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Opinion N\u00b0 0002\/2016<\/a><\/span>, the Andean Community Secretariat refused to consider a complaint from a Colombian patent applicant against the Republic of Ecuador arguing the Ecuadorian Patent Office (IEPI) fees were exorbitant and made entering the Ecuadorian national phase prohibitive.<\/p>\n<p style=\"text-align: justify;\">The Secretariat dismissed the complaint arguing the patent applicant had not demonstrated legitimate interest and therefore had no standing.\u00a0\u00a0 Specifically, the Secretariat argued that since the applicant had not actually filed its application and disbursed the fees, no damage had occurred.<\/p>\n<p style=\"text-align: justify;\">The Secretariat further considered that, under Andean law, Ecuador had absolute and unfettered discretion to set the fees it considered.<\/p>\n<p style=\"text-align: justify;\">Maintaining a patent alive in Ecuador exceeds USD $120,000 in annuities.\u00a0 The initial filing fee, including upfront annuity payments, are approximately USD $5,000 (excluding claim overage).\u00a0 Replying to an office action can typically generate fees exceeding USD $15,000 based on specification page count.<\/p>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA\u00a0| Intellectual Property &#8211; Patents\u00a0| <strong>OlarteMoure joins the <\/strong><em>Pacts for Innovation<\/em> Initiative<\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">OlarteMoure has been registered as a provider to the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/pactosporlainnovacion.colciencias.gov.co\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Pacts for Innovation <\/em>initiative<\/a><\/span>, promoted by the Colombian Administrative Department of Science, Technology and Innovation (Colciencias in Spanish) and advised by Ruta N Medellin, among others.<\/p>\n<p style=\"text-align: justify;\"><em>Pacts for Innovation<\/em> is one of the strategies adopted by the Colombian Government to achieve in 2019 a Gross Domestic Product investment exceeding 1% in science, technology and innovation.\u00a0 It aims to strengthen the commitment of companies to invest in innovation.<\/p>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>US\u00a0| Patents| <strong>The U.S. Patent and Trademark Office (USPTO) issued new examples on eligibility of subject-matter particularly related to life sciences<\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">These <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/05\/Subject-Matter-Eligibility-Examples-Life-Sciences.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">additional illustrative examples<\/a><\/span> are based on the \u201c<span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/05\/2014-Interim-Guidance-on-Patent-Subject-Matter-Eligibility.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">2014 Interim Guidance on Patent Subject Matter Eligibility, 79 Fed.
