Current law prohibits professors at public universities from receiving any remuneration different to the university salary.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA and PERU | Trademarks\u00a0| <strong>Colombian and Peruvian IP Offices join the<\/strong><\/strong><\/span><span style=\"text-decoration: underline;\"><strong><strong>\u00a0TMclass trademarks database<\/strong><\/strong><\/span><\/h3>\n<p style=\"text-align: center;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">As of April, the Superintendence of Industry and Commerce \u2013SIC- (Colombia) and the Indecopi (Peru) are now members of the <span style=\"text-decoration: underline;\"><a href=\"http:\/\/tmclass.tmdn.org\/ec2\/news\" target=\"_blank\" rel=\"noopener noreferrer\">TMclass database<\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\">TMclass allows a unified search through the Goods and Services classification databases from Trademark Office Members, aiming to simplify the goods and services classification process.<\/p>\n<p style=\"text-align: justify;\">Some of the TMclass members worldwide are the World Intellectual Property Organization (WIPO), the European Union Intellectual Property Office, the United States Patent and Trademark Office, among others. In Latin America, the Brazilian and Mexican IP Offices are TMclass members.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">..<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA\u00a0| Intellectual Property\u00a0| <strong>Andean Court of Justice: no infringement exists if alleged infringer ceases acts prior to lawsuit<\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">By means of <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/05\/TAJ-382-IP-2015.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Prejudicial Interpretation N\u00b0 382<\/a><\/span>, the Andean Court of Justice (ACJ) issued a questionable precedent for infringement actions.<\/p>\n<p style=\"text-align: justify;\">The ACJ claims that an infringement action only proceeds when the plaintiff demonstrates the infringing acts are being performed at the complaint filing date. \u00a0Therefore, an infringement action cannot be pursued if the infringement ceases before the filing of the complaint.<\/p>\n<p style=\"text-align: justify;\">This judgment would allow the infringer to avoid a declaration of infringement for past conduct and any damages caused.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #ffffff;\">.<\/span><\/p>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>COLOMBIA\u00a0| Regulatory | <strong>Decree delegates to National Medicine and Medical Devices Price Commission the price fixing of pharmaceuticals<\/strong><\/strong><\/span><\/h3>\n<p><span style=\"color: #ffffff;\">.<\/span><\/p>\n<p style=\"text-align: justify;\">On 29 April 2016, the Ministry of Health and the Ministry of Commerce issued <span style=\"text-decoration: underline;\"><a href=\"http:\/\/www.olartemoure.com\/wp-content\/uploads\/2016\/05\/Decreto-705-de-2016.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Decree 705 (2016)<\/a><\/span>, which entrusts to the National Medicine and Medical Devices Price Commission (created by Law 100 of 1993) the definition of methodologies and mechanisms to use for setting maximum prices for pharmaceuticals prices.<\/p>\n<p style=\"text-align: justify;\">The Commission will fix the maximum sale prices allowed \u2013if necessary- and will determine the margins for the distribution and commercialization of medicines.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>COLOMBIA\u00a0| Intellectual Property\u00a0| Colombian Congress evaluates Bill that allows \u00a0universities to create Research Spin Offs .
