The Mexican Institute of Industrial Property (IMPI) has informed WIPO about the mandatory filing of a declaration of real and effective use for international registrations protected in Mexico under the Madrid System. Holders must file this declaration directly before the IMPI in two situations:<\/p>\n

    \n
  1. Within three months following the third year of grant of protection of the sign in Mexico, provided that the national registration is after August 10, 2018.<\/li>\n
  2. Within three months after the publication of the renewal of the international registration in the WIPO Gazette, if at least three years have elapsed since the grant of protection of the sign in Mexico.<\/li>\n<\/ol>\n

    In the first case, the omission of the declaration causes the automatic expiration of the registration. In the second case, IMPI will give an additional term of two months to remedy the deficiency. If the declaration is not filed, the registration will expire without the need for a formal declaration by IMPI.<\/p>\n
