After receiving complaints and applying sanctions, on 10 October 2023, the SIC issued External Circular No. 002, which established the following measures:<\/p>\n<p>[\/et_pb_text][dsm_icon_list icon_font_size=&#8221;18px&#8221; list_space_between=&#8221;0.8em&#8221; image_max_width=&#8221;28px&#8221; _builder_version=&#8221;4.22.2&#8243; _module_preset=&#8221;default&#8221; text_font_size=&#8221;1.1em&#8221; text_line_height=&#8221;1.4em&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;et_body_layout&#8221; sticky_enabled=&#8221;0&#8243;][dsm_icon_list_child text=&#8221;FINTECHs must provide written information to consumers on interest rates, periodicity of payments, and number of installments at the time of entering into the contract. &#8221; use_icon=&#8221;off&#8221; image=&#8221;https:\/\/www.olartemoure.com\/wp-content\/uploads\/2023\/05\/number-one.png&#8221; alt=&#8221;number one&#8221; _builder_version=&#8221;4.22.2&#8243; _module_preset=&#8221;default&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;et_body_layout&#8221; sticky_enabled=&#8221;0&#8243;][\/dsm_icon_list_child][dsm_icon_list_child text=&#8221;Default interest may only be calculated on overdue installments. In addition, FINTECH must provide information on credit assignments, guarantees, prepayments, among others.   &#8221; use_icon=&#8221;off&#8221; image=&#8221;https:\/\/www.olartemoure.com\/wp-content\/uploads\/2023\/05\/number-two.png&#8221; alt=&#8221;number two&#8221; _builder_version=&#8221;4.22.2&#8243; _module_preset=&#8221;default&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;et_body_layout&#8221; sticky_enabled=&#8221;0&#8243;][\/dsm_icon_list_child][dsm_icon_list_child text=&#8221;Threats and intimidation of consumers and third parties are prohibited, under threat of sanctions. The Attorney General&#8217;s Office may intervene if necessary. &#8221; use_icon=&#8221;off&#8221; image=&#8221;https:\/\/www.olartemoure.com\/wp-content\/uploads\/2023\/05\/number-three.png&#8221; alt=&#8221;number three&#8221; _builder_version=&#8221;4.22.2&#8243; _module_preset=&#8221;default&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;et_body_layout&#8221; sticky_enabled=&#8221;0&#8243;][\/dsm_icon_list_child][dsm_icon_list_child text=&#8221;FINTECHs must guarantee that their services do not harm consumers and provide clear, truthful information in Spanish, excluding abusive clauses from their contracts. &#8221; use_icon=&#8221;off&#8221; image=&#8221;https:\/\/www.olartemoure.com\/wp-content\/uploads\/2023\/05\/number-four.png&#8221; alt=&#8221;number four&#8221; _builder_version=&#8221;4.22.2&#8243; _module_preset=&#8221;default&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;et_body_layout&#8221; sticky_enabled=&#8221;0&#8243;][\/dsm_icon_list_child][\/dsm_icon_list][et_pb_text _builder_version=&#8221;4.22.2&#8243; _module_preset=&#8221;default&#8221; text_font_size=&#8221;1.1em&#8221; text_line_height=&#8221;1.5em&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;et_body_layout&#8221; sticky_enabled=&#8221;0&#8243;]These measures respond to previous sanctions, such as fines of approximately COP 600,000,000 recently imposed on two companies for including excessive interest rates and not providing complete and adequate information to consumers. In addition, the reimbursement of monies overcharged to consumers was ordered, which demonstrates that the authority will exercise rigorous control over this type of activity.
